Employers must weigh eight statutory factors before denying you for a conviction

New York's Correction Law Article 23-A prohibits denying employment or a license because of a conviction unless there is a direct relationship between the offense and the job, or hiring you would involve an unreasonable risk to people or property. The agency or employer must weigh factors including the state's public policy of encouraging employment, the specific duties of the job, how long ago the offense was, your age at the time, seriousness, evidence of rehabilitation, and the employer's legitimate interest in safety.

Two certificates are available depending on your conviction history

A Certificate of Relief from Disabilities is generally available where you do not have more than one felony conviction. A Certificate of Good Conduct is the route where you have more than one, and requires a waiting period that depends on the most serious offense class. Either is issued by the sentencing court or by the Department of Corrections and Community Supervision, and both create a presumption of rehabilitation under Article 23-A.

New York has both a petition-based sealing route and automatic sealing

Under CPL 160.59, you may petition to seal up to two eligible convictions — no more than one of which may be a felony — after ten years have passed since sentencing or release from incarceration, whichever is later. Separately, New York's Clean Slate Act provides for automatic sealing of eligible convictions after a waiting period once you are no longer under supervision and have no new criminal charges. Both routes exclude certain offenses, including sex offenses and the most serious felonies.
