Blanket bans can violate the Fair Housing Act
HUD guidance explains that a housing provider's blanket refusal to rent to anyone with a criminal record can violate the Fair Housing Act where it produces an unjustified discriminatory effect, and that arrest records alone do not prove underlying conduct.
Providers are expected to consider the nature and severity of the conduct and how much time has passed, rather than applying a single automatic rule.
