Occupational Licensing

A large share of U.S. jobs requires some form of license, certification, or registration — healthcare, security, cosmetology, real estate, childcare, commercial driving, trades, and many more.

When a licensing rule blocks a role, the employer usually cannot override it. That is a good thing to know early, because it tells you where to direct your effort: to the agency, not the hiring manager.

Many states limit licensing denials to convictions that bear a direct relationship to the licensed activity, or that would create an unreasonable risk. New York's Correction Law Article 23-A is a widely cited example and applies to both employment and licensure, listing factors the agency must weigh — including the time elapsed, your age at the time, evidence of rehabilitation, and the state's interest in supporting employment for people with records.

A growing number of states let you request a decision about your record before you spend money on a program — sometimes called a predetermination, preliminary determination, or advisory opinion.

It is one of the most valuable and least-used tools available. Ask the licensing board directly whether one exists, and get the answer in writing.

If a school tells you a conviction is not a problem, verify it with the licensing agency anyway. The school is not the decision-maker.
